A savvy business owner will always test certain skills before hiring, this much we know. This is the boss’s way of checking that the candidate has the appropriate skills to complete the tasks required. For example, if the owner of a design company is looking to hire a new designer and the candidate can’t even turn on the computer then the cool and calculating business owner will know that something is up; their CV has been fabricated! Every employer knows that an unfair dismissal means hearing after hearing with a disgruntled CCMA commissioner and a despondent, but slightly arrogant, ex-employee. It can be an extremely messy business which results in a loss of productivity and revenue generation for the employer, in addition to being a complete waste of time.

An employer may argue that seeing as the business belongs to them an employee’s performance is not private, which is a valid point. However, an employee’s employment history is technically none of potential employers business and as a result is a private matter. There are a number of boxes which need to be ticked before a reference check can be conducted:
- The applicant must give their consent to a reference check
- The information must be truthful
- The referee must show interest in giving information
- The employer must show interest in receiving information
